CNA Rose Hurt Her Back Lifting a Patient – Workers’Comp Denied

| Grace

Healthcare jobs can be incredibly physical, especially when your job involves helping patients who cannot move or care for themselves.

Our client Rose was a Certified Nursing Assistant working at a nursing home in Washington, D.C. She spent her career caring for patients who were bedridden, unable to walk, or needed help with everyday tasks.

One day, Rose hurt her back while lifting and turning a patient who could not move on her own.

She did everything right. She reported the injury to her supervisor, went to occupational health, and got medical treatment.

At first, the workers’ compensation insurance company paid benefits. Then they stopped.

The insurance company sent Rose for a medical evaluation, and the doctor said her back problems were caused by a degenerative condition instead of the work injury, even though Rose had not been having those symptoms before she hurt herself lifting the patient.

Rose knew what happened to her back, and we weren’t going to let the insurance company brush it off as just age or degeneration.

She stayed with it while we fought to prove that she was hurt at work and that her injuries kept her from returning to the physically demanding job she had done for years as a CNA.

After a long fight, Rose reached a settlement that allowed her to retire and move to South Carolina, somewhere she had always wanted to live.

Hear From Attorney Frank Kearney

Attorney Frank Kearney talks about Rose’s case, how the insurance company tried to blame her back injury on degeneration, and how we helped secure her workers’ comp settlement.
