Hit by an Uninsured Driver in DC

Getting hit by an uninsured driver when you’re at work can be a nightmare. But we can help.

SL was working as a property manager in Washington, D.C., so she had to drive throughout the city, inspecting residential properties, meeting contractors who were renovating apartments, meeting with investors, and addressing the needs of tenants.

Most days, she would leave her office and go see four or five complexes throughout the city.

Like anyone working in D.C., Maryland, or Virginia, SL was covered by workers’ compensation as long as she was traveling for work and not on her way home. So driving from one apartment complex to the next, she was covered.

On her way to an apartment complex near Navy Yard, she was hit by a speeding car on 695 in D.C. And like so many reckless drivers, this one did not have insurance.

It was a bad crash, and SL developed post-concussion symptoms like headaches, memory loss, and dizziness that required specialized medical treatment. She couldn’t work because of those symptoms, so we made sure she received workers’ compensation benefits and the medical treatment she needed.

Ultimately, the workers’ compensation settlement for her injuries provided her with an opportunity to move out of state and start a new chapter in her life.

What about the driver with no insurance who caused the accident? There was no recovery against him personally (people who don’t have car insurance usually don’t have any money anyway).

But SL was smart. She had uninsured motorist coverage on her own car insurance policy, and that insurance coverage stepped in to pay the damages that the reckless driver with no insurance caused.

Remember, if you get hurt at work or on the job, and some other person or company causes the injury or accident, you can pursue both workers’ compensation benefits and a case against the other driver. But there are very specific rules and steps to follow in order to pursue both. Even a lot of lawyers don’t know the process.
